How To Stop Big Government

I have received many emails from readers wanting to know more about nullification and what repercussions it could have on a state. In the writing of my first article, "Could Nullification be America's Future," I stated I was not sure if the government could somehow persecute a state for imposing nullification. Checking into it I have learned more about the subject.

For those of you who did not read my first article, nullification is when a state says; 'In the boundaries of our State we do not accept the law Government has handed down and will not enforce it. We deem it unconstitutional.' This could be a states greatest asset to beating Big Government.

Nullification does not require any decision or action from any branch of the Government, nor does it require a court ruling and does not require permission from any person or institution outside of one's own State.
It can not be leagally repealed by Congress without amending the US Constitution, nor can it be overruled by the Supreme Court or abolished by any executive order.

The Government hopes people never hear of it because this ties their hands. 25 States over the past 2 years have enacted nullification over the real ID Act. It has also been imposed by many states for the sale of medical marijuana. None of these states have been persecuted, the Gov finally turned their back to it.

If the Gov did try to stop a State from nullifing, they could send agents in to uphold the law. If that happened a State could have County Sheriffs require Federal Agents to have written permission before acting in their County.
Washington would then have to consider if the agents going in would uphold the order and punish people for imposing their Constitutional Rights. Many of them could ignore the order because they believe the same way we do. If enough States nullify, the Gov does not have the manpower to cover the order.

This would place Gov in a position where they would have only one way to enact it that would be to bring in Interpol. In Dec. of 2009, Obama enacted an executive order giving Interpol power over all law enforcement agencies, FBI and Congress.
Interpol is the world police. He gave them a free hand over us. They can not be questioned and do not have to show any records they acquire. They have the power to take your home or business without repercussions. If it did happen then we have surpassed Socialism and embedded Dictatorship into our Country.

    From everything I read nullification would be the answer to many states problems. I guess what I don't understand is why more states aren't using it. Could this also work against gun laws if the Gov tried to take our guns away. I am going to find out more information on this if I can and will let you know what I find out.

    Nullification is quite interesting. I did not know about it before. I don't think I ever learned about that in Political Science. Now if the more people were knowledgeable about this maybe some of the states would use it.

  5. Had to come back after hitting the site, I like Ron Paul!! Wish he had been able to become a serious contender for President. I didn't like the choices the dem and reps came up with and wow did we end up getting screwed !!

  6. I agree with you P. Since coming to this blog I have tried to keep up with what the Tenth Amendment Center is doing. I can't believe more states aren't using nullification if it is so easy. We may see more of this in the future. If my roommate doesn't get on the ball, I may Nullify her!

  7. Rebel Bill - Yes this does include firearms. At this time there are 22 states considering a bill known as the "Firearms Freedom Act." This bill states that guns, accessories and ammunition made within a state also sold within a state are not subject to Federal Law. Nor can be regulated by the Interstate Commerce Clause.
    Montana and Tennessee passed a Firearms Freedom Law in 2009.
    South Carolina has now introduced a bill nullifying gun registration.

    Does this mean that if Congress passes a law making gay marriage okay that a state can nullify it and make it illegal?

    Jay, Normally the state votes in a law but if Congress did pass a law making it legal my son-in-law (attorney) said that a state could nullify it.

    If congress did pass a law making gay marriage legal I'm sure we would see a number of states using the nullification law.

  11. Nullification could become a states way to stop government in it's tracks. The only thing I wonder about is if this happens will the government vote in other laws that could override this?

  12. Knowing this bunch of gargbage rats we have in office now I am sure they will be trying something. It wouldn't surprise me if Nancy Pelosi is already working on it.
